IAIINATIO.N Ol' Following the testimony of Mayor Mcllenry, the motion to dismii-s the action was made by Attorney Williams, Mr. Keefe stated he had planned to present if brief. Mr. Williams referred to cases In tho supremo court in which certain ho-im-iits had been declared illegal, but those cases were based upon certain provisions in the bequest, lie cited the rase of Mrs. Ueaeh, from this city, which was passed upon by the" supreme court.

Attorney Kichter interposed the comment that, if the city could not purchase the property, it could not validly accept it as a gift. The court replied that the property in question i one of great value and may be devoted to any one of many uses. If its acceptance constitutes a loss through remcnal from the tax rolls, the same might be said of other property acquired by the city. In such a case, where the property was given absolutely without reservation, the donor would have the right to expect the city would not dispose of It to speculators at the best bid. TKIX; TIIK OH' TIIK TAX HOIXS The fact that the property had been taken off tho tax roiis did not depreciate its value, tho court said, and the fact that It had been impossible to sell it for more than $25,000 would indicate that the assessment of $110,000 was not Justified.

He declared It is not what a palatial home costs a niHn which Is the basis for assessment. It Is what the property will bring If placed on sale. He said he did not see that the statutes at present placed any re straint upon the city in accepting property for which use might be found later. The location of the Sawyer property is such it is valuable for park purposes, at least, if nothing else. was u.

Mr. Keefe said it was apparent that the court had already given the matter consideration and if the court 80 desired, he was willing that an order be entered at once, thereby expediting the case in its course to the supreme court, where It was a foregone conclusion it would finally go. However, he wished It to be made a matter of record that, if the attorney had any further cases to cite, the court would be glad to hear them.

Also he would be willing to listen to arguments or carefully to consider any briefs that might be Mr. Keefe said he did not believe he cured to present any further arguments or citations. The court thereupon ruled that "The motion for the defendant Is granted. Vou may prepare nuch an order and I will sign It." GAIN IN CIRCULATION Oshkosh Fublic Library In Ihe First of the New Year Had Added Activities. The first month of the new year, 1924. was a period of activity at the Oshkosh public library, and the statis- the circulation mi iii.iin niiiRi) uiiu Liiaiiciies. At the main library in the adult de- partment, 12.022 books were Issued during January, 1924. over 10,670 for the same month of 1923, or a gain of 1,352.

There was a gain of 396 in tho Juvenile department In the first month of this year. 3,393 books being circulated this January, compared to 2,997 for last January. The total gain in the circulation of the main library, therefore, was 1,743. The adult department of the south side branch gained 124 in clrculaton in January, 1924. 1.620 books being issued that month, over 1,332 for the same month of the previous year.

In the Juvenile department, 1.8S2 books were sent out the first month of the current year, compared to 1.73S for the name period In 1923. or a gain of 1SS. The south side branch had a total gain of 312. During January, 194. 293 adult books were Issued from the West Algoma branch, while In January, 1923, 262 books were circulated, giving an Increase of 31.

There was a gain of 64 In the number of Juvenile books circulated. 599 being the number Issued this January, compared to 535 for last January- The total gain at the Wtst Algoma branch was 95.
